Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and The Jobsmith, an independently operated service based in the United States ("The Jobsmith," "we," "us," or "our"). They govern your access to and use of the website at thejobsmith.net, our resume-tailoring and job-search tools, and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Notice. If you don't agree, don't use the Service.
1. Who can use the Service
You must be at least 18 years old and located in the United States to use the Service. We provide it for individuals in the U.S. and do not target or market it elsewhere. By using the Service you confirm you meet these requirements. You may use the Service only for lawful purposes and only for your own job search (or one you are authorized to act on).
2. Your account
You'll create an account with an email address and password, or by signing in with Google. Keep your login credentials confidential — you're responsible for everything that happens under your account. Provide accurate information and keep it current. One person, one account; don't share accounts or impersonate anyone. Tell us promptly at [email protected] if you suspect unauthorized use.
3. What the Service does — and your responsibility for accuracy
The Jobsmith helps you search jobs and generate tailored ("forged") resumes and related materials from a resume and career details you provide. Forged output is produced with the help of AI. The Service is designed to draw only on material from your own uploaded resume and profile, and we work hard at that guardrail — but AI systems can make mistakes, and outputs may contain errors, omissions, or wording that doesn't fit your situation.
You are solely responsible for reviewing every resume, message, or other output before you send it to anyone, and for the truth and accuracy of anything you submit to an employer. Don't use the Service to fabricate credentials, misrepresent your experience, or create misleading materials. The Service is a drafting tool, not career, legal, financial, or professional advice, and we don't guarantee any job, interview, or outcome.
4. Plans, pricing, and automatic renewal
The Service offers a Free plan and paid subscription plans (currently Founder, Standard, and Pro), plus optional one-time forge packs. Current prices, features, and usage limits are shown on the signup and account pages and are incorporated into these Terms.
Paid subscriptions renew automatically. When you subscribe, you authorize us and our payment processor to charge your payment method the then-current plan fee (plus any applicable taxes) at signup and automatically at the start of each billing period — monthly, on your billing anniversary — until you cancel. By subscribing you acknowledge that your subscription has a recurring charge and that it will keep renewing until you cancel it.
5. Forge packs
A forge pack is a one-time purchase that adds a set number of extra forges to your account. Packs are charged once (not recurring), and any unused forges expire on the date shown at purchase. Packs are consumed as you use them and, like subscriptions, are non-refundable (see Section 8).
6. Price changes
We may change plan prices and features. We'll give notice of a price increase to a plan you're on before it takes effect on your next renewal, and your continued subscription after that date is your acceptance of the new price. If you don't agree, cancel before the renewal. Locked-in promotional pricing (such as the Founder tier) will be honored on its stated terms for as long as your qualifying subscription remains active.
7. Cancellation
You can cancel a paid subscription at any time from your account page. Cancellation stops the next automatic renewal; your paid features remain active through the end of the billing period you've already paid for, after which the account moves to the Free plan. To cancel, you don't need to contact us or give a reason — it's one action in your account.
8. No refunds
Except where a refund is required by law, all payments are final and non-refundable. We do not provide refunds or credits for partial billing periods, unused forges, forge packs, or downgrades, and cancelling does not entitle you to a refund of amounts already charged. 9. Your content
You keep ownership of the resume, career details, and other materials you upload ("Your Content"), and of the forged output generated for you. You grant us a limited, non-exclusive license to host, process, transmit, and display Your Content solely to operate and provide the Service to you — including sending relevant text to our AI provider to generate your output (see the Privacy Notice). This license ends when you delete the content or your account, except for backups retained briefly as described in the Privacy Notice. You represent that you have the right to upload Your Content and that it doesn't infringe anyone's rights.
10. Acceptable use
Don't upload resumes or personal information you have no right to use. Don't probe, scrape, overload, reverse-engineer, or interfere with the Service or its security; don't use it to generate misleading credentials, to violate any law or third party's rights, or to build or train a competing product. We may apply usage limits, rate limits, and other safeguards, and we may suspend or revoke access for abuse.
11. Our intellectual property
The Service — including our software, design, branding, and the "The Jobsmith" name — belongs to us and is protected by intellectual-property laws. These Terms don't grant you any right in our marks or software beyond the limited right to use the Service. All rights not expressly granted are reserved.
12. Feedback
If you send us feedback, suggestions, or ideas, you grant us a perpetual, royalty-free license to use them to improve the Service, without obligation or compensation to you — with our thanks.
13. Third-party services and employers
The Service may surface job postings from third-party boards and aggregators and may rely on third-party providers to function (for example, payment, email, hosting, and AI providers). We don't control third-party sites, employers, or postings and aren't responsible for their content, availability, accuracy, hiring decisions, or practices. Your dealings with any employer are solely between you and them.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied — including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. You use the Service, and rely on any output, at your own risk.
No employment outcomes are promised. The Jobsmith is a tool for preparing and targeting your application materials — it does not and cannot control employers' hiring decisions. We do not guarantee that using the Service will result in you finding a job or receiving callbacks, responses, interviews, or offers, and we make no promise that the Service will increase the likelihood of any of those outcomes. Any statistics, fit assessments, or research the Service presents are informational only and are not a prediction of your individual results.
15. Limitation of liability
To the maximum extent permitted by law, The Jobsmith will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost job offers, or lost or corrupted data, arising out of or related to the Service — even if we've been advised of the possibility. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless The Jobsmith from any claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any law or third-party right, including in materials you upload or submit to employers.
17. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we're required to by law, or if we discontinue the Service. On termination, the license in Section 9 and your right to use the Service end; sections that by their nature should survive (including content ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
18. Dispute resolution — arbitration and class-action waiver
Please read this section carefully — it affects your legal rights. Except for the exceptions below, you and The Jobsmith agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court. Arbitration will take place on a documents-and-remote basis where possible, and the arbitrator can award the same individual relief a court could.
Class-action waiver. You and The Jobsmith agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of a class proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual-property rights.
30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out won't affect any other part of these Terms.
19. Governing law and venue
These Terms and any dispute are governed by the laws of the State of Nebraska, USA, without regard to its conflict-of-laws rules. To the extent a claim is not subject to arbitration, you and The Jobsmith agree to the exclusive jurisdiction of the state and federal courts located in Nebraska.
20. Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes, we'll post the updated Terms here with a new effective date and, where appropriate, give notice in the app or by email. Your continued use after changes take effect means you accept them; if you don't agree, stop using the Service and cancel any subscription.
21. General
These Terms and the Privacy Notice are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms; we may assign them to a successor (for example, in a merger or sale of the business). We aren't liable for delays or failures caused by events beyond our reasonable control.
